On September 14, the court ruled, in a partially granted preliminary injunction, that Spribe must prevent the supply of Aviator to platforms without authorization to operate in Brazil; the Public Prosecutor's Office of the Federal District (MPDFT) announced the measure the following day. The measure is not final and does not constitute a general ban on the game.
The measure matters to Brazilians because, according to the agency, consumers may have difficulty distinguishing an authorized site from an irregular one when both display the same game.
Block targets the offering infrastructure
The order is not limited to removing an internet address. According to the MPDFT, it covers technical links with unauthorized operators, such as integrations and access credentials, as well as mechanisms related to the offering. This scope, the agency explains, seeks to prevent a domain change from allowing the irregular offering to continue.
The company must also adopt monitoring, traceability, georestriction, and blocking measures to prevent the game from being used by irregular platforms, according to the MPDFT.
What remains under discussion and how to check
Spribe's defense told Folha that it will comply with the decision, but challenged the treatment directed at a single supplier. This is the company's position, not a judicial conclusion. The report states that the supply of Aviator to authorized platforms continues at this time and that the judge may reassess this point after adversarial proceedings.
To check a company's status, readers can use the SPA/MF lookup. The public service is free, does not require login, and is accessed through the Iniciar button on the gov.br page. The related casino24.pro guide advises checking the brand, responsible company, CNPJ, domain, and current operating status.
- Spribe was given a deadline of ten days to comply with the determinations, according to the MPDFT.
- The stipulated fine is R$ 100 thousand per day, only in the event of non-compliance.
- The MPDFT is seeking R$ 110 million for collective moral damages in the lawsuit; this is a claim, not an amount already awarded.
