BNLData reported that Provisional Measure No. 1.394, of 25 September 2026, may lapse in Congress or be suspended by Luiz Fux; this matters because of the nationwide ban on fixed-odds betting recorded in the Official Gazette. Paulo Ganime told Poder360 that it may be struck down by Fux or lapse, but the outcome and decision date are unknown.
- According to the Official Gazette of the Union, the ban covers the operation, offering, intermediation, and advertising of fixed-odds betting lotteries.
- The text includes activities in physical or virtual environments.
- The rule also covers offers made by an agent based abroad to a person located in the national territory.
- The text provides for the termination of the covered concessions, permits, and authorizations at the end of thirty days from publication, while preserving the obligations and prohibitions during the transition period.
Assessment does not constitute a decision
According to BNLData, Ganime considered it more likely that Congress would allow the Provisional Measure to expire rather than approve it. Poder360 attributed to the executive director of Associação pelo Livre Mercado the assessment that the measure may be struck down by Luiz Fux or expire in Congress.
These are assessments published by the association, not a legislative or judicial decision. BNLData reported that, while Congress has not deliberated on the Provisional Measure, the effects of the ban remain in force. Therefore, the possibility of expiry does not mean that it has already occurred, and the mention of a suspension by the minister does not indicate that a suspension has been implemented.
The Official Gazette of the Union establishes, throughout the national territory, a ban on the operation, offering, intermediation, and advertising of these bets. The scope includes physical and virtual services, as well as offers from agents based abroad intended for people in Brazil.
Has the Provisional Measure already ceased to apply?
Access to websites and applications
The Official Gazette ordered operating agents to make access to websites and applications intended to offer fixed-odds betting unavailable ten days after the publication of the Provisional Measure, including in virtual stores. The text provides for blocking in the event of noncompliance.
It is still unknown whether Congress will approve the measure or allow it to lapse. There is also no confirmed date or outcome for a possible decision by Fux on the suspension requests.
