Will my betting site refund me? MP 1.394 deadlines
Provisional Measure (MP) 1.394, published in Brazil’s Official Gazette on 25 September 2026, banned fixed-odds betting in Brazil and set out how players get their money back: the company secures the funds and sends its banks a list of everyone with a balance; the bank transfers the amount to an account in the player’s CPF (individual tax number). Below are the steps, the dates as counted from the text, and the passage of the MP behind each one.

Who this procedure covers
The bank refund procedure was written for “agentes operadores de apostas” — which the MP defines as companies that received a federal authorisation (art. 3, V). The MP also applies it, where relevant, to fixed-odds lotteries authorised by states and the Federal District (art. 2 §2). To find out whether your platform had a federal authorisation, use the register checker.
The SPA/MF register lists federal authorisations only. For platforms with no authorisation at all, the MP provides no such procedure; in that case, keep your evidence and use the consumer protection channels listed below.
“agente operador de apostas - pessoa jurídica que tenha recebido autorização para explorar loterias de aposta de quota fixa”
“O disposto nos Capítulos II e III aplica-se, no que couber, à exploração de loterias de aposta de quota fixa de que trata este artigo”
What to do now
- Use the checker to see whether the platform was in the SPA/MF register. Is this betting site trustworthy? Check the register
- Keep the bank account your deposits came from active and make sure the CPF registered on the platform is yours: refunds go by CPF, preferably to the original account (art. 9 §1).
- Keep evidence: screenshots of your balance, open bets and deposit and withdrawal history, plus Pix or transfer receipts. The MP does not require this; it is our advice, useful if amounts are disputed.
- Be wary of anyone charging a fee to “release” your balance. The MP speaks of full repayment of the amounts owed (art. 8, I) and bans deductions on refunds of voided bets (art. 7 §2); paying up front is not part of this procedure.
- If the money has not arrived after the banks’ deadline, complain to the company’s customer service (SAC) and note the ticket number. If that fails, use consumidor.gov.br and your state’s Procon.
- If your platform was not in the register, file the complaint anyway and keep all your evidence.
